Still, it was done over 12 years ago. Whether or not they were going to restart their nuclear programme is debatable. Having not given the order to start the nuclear programme since the gulf war (remember 7-8 years after the gulf war, Iraq could feasibly have restarted its' nuclear weapons programme without anyone having an inkling of waht was going on):

Whether is was based upon highly suspect intelligence or the government "sexing" up the report, I doubt we'll ever find out. However, my gut feeling says that it was the latter. And, since the original claim was the basis for going to war, it could be argued that the war was illegal.
