Okay, I think I've got it. McVities were trying to prove it was a biscuit to avoid paying tax. It was a different (higher) rate of tax on cakes. However, the case failed because they couldn't conclusively prove that it was a biscuit. Therefore, logic suggests that it is a cake. The fact that it is stocked in the biscuits section was a reason they cited in the case but that failed because it was irrelevant.
