I was talking with Cookie Monster and we both seemed to agree that a games auction site would be a decent thing to have on SR, for people getting rid of their unwanted games, maybe even get decent prices for them and stop getting ripped off by trading them in at game for £20, what do you think??

Sorry thats what i meant, you just have one of those buttons that say "I Agree" that you have to click

Exactly, and if the disclaimer MUST be signed before a sale can take place then the contract is water tight.

Also buyers and sellers who do not fulfill their part of the contract in whole may be banned from buying/selling in the future

How about this:
You have a forum where people are free to post their private advertisments.
There is a completely solid disclaimer, which means that business takes place between private parties and does not involve Special Reserve in any way.
But you also have a legally binding contract that the seller and the buyer must agree to before the sale can take place, specifying how bad it is to be a con and that issues like this may be resolved in court

Exactly, thats why there are more stumbling blocks to this than I first thought, but a simple properly written legal disclaimer could shift any liability away from SR (Tony, you'd better check with a solicitor on that, seeing as I did Scot Law and not English!)
