Since it has a short memory (ie it's hardly developed a personality) and is in pain I also vote that you should kill it.

Ummm... I'm not sure... I think it could have been in the all the heat lately but it would only be in it for an hour or so nearing to night.

Yup its gunna die, mine stopped swimming as much and its back was just all bendy, and all floppy.
It died about 5 days later, bout 3 days ago.
Hell it tasted good when i cooked it.
