This could lead to a number of different outcomes. Microsoft might win, even so, the consoles launch may be delayed whilst awaiting the outcome of the courtcase.
Xbox technologies might win, so the XBox will have to undergo a name change.
If Microsoft release the console, only to lose the courtcase at a later date they'll have to recall all of the consoles.
Given Microsoft aren't the US courts favourite company, it should be interesting.

If they do have to recall all their consoles or delay the release of it, the PS2 and GameCube could have already started making sure that when they do release the Xbox they'll be slaughtered in the popularity scales.
Also by that time everyone is going to be fed up waiting for the Xbox and so could very well ahve invested in a different console.

Microsoft have always hinted that the 'X-Box' name may only be a working title, much as Nintendo's Ultra64, which became
N64.

I think X-Box is the 'real' name for their console and having to change it now would be a bad thinas it's already a recognied name (by some people anyway!)
Titles get changed all the time during production, especially when they are so far from the production line.
It is an established name, but they could always release it with one name, and just allow everyone to use XBox as an unofficial nickname, which is still perfectly legal as long as Microsoft do not refer to it as the XBox themselves...
