It's the same as making a copy of a DVD and giving them that to keep.
If you download a movie you don't need to give it back after a while, you can jsut keep it forever more. And it's not as if the person you download it off of loses the movie, so it's not like loaning them.

But he's not keeping it. If you give him it to keep, he's getting a DVD, which you paid for, for free, but you don't have it anymore, so the producers don't lsoe out on any money.

It is illegal, but that's a silly law, as it's no different from going to a friends houise and watching TV because you don't have your own TV licence.
