Seeing as a ROM is a copy of the software, Nintendo would be the only people who would be able to download it.

Does that mean if Nintendo download ROMS of their own titles that they are breaking the law?
It's all very well having paid for the software, but if the company are expecting you to have the correct hardware to play it, and have their prices and marketing strategy adjusted accordingly, then it's going to be a big problem...
I guess it always depends how successful the device is. If there are serious knock-on effects, then I expect things will get messy.

Sony didn't like it and tried to stop it, having their objections overturned in court. Nintendo may not like it, but I don't see that they'd have any more chance of stopping it than Sony did.
It raises once again the whole question of emulation and whether it's right or wrong. I suppose that as long as you have to buy the original software, it shouldn't be a problem. Unless of course the software in question is so old that you can't buy it any more; then you enter a whole other minefield!
I haven't checked myself though.....
Sounds very interesting. Where did you get this info? I'd like to read a littel more about it.
