Last year, before I was scheduled to go away to Canada, I phoned T-Mobile to arrange to cancel my phone contract, which was to take effect as soon as the 1 year contract period was up (late march this year).
I was told this was possible, and that my contract would terminate this march.
In february/march I phoned again, and checked that my cancelation was going to happen. They told me it was.
Since then they've kept billing me and today I phoned up to find out why.
They told me they have no records of either my cancelling the contract, or me phoning to check the cancelation.
They also told me it's 'impossible' to cancel a contract by giving more than 30 days notice, so in fact I 'shouldn't' have been able to arrange to cancel so far ahead of the finishing date.
It looks like some kind of a screw-up on the original request to cancel, and some kind of incompetent muppet who confirmed that it was going to cancel.. I'm not sure how that could happen though, how someone could confirm my cancelation when it wasn't scheduled to happen...
My other theory is that they took the original cancelation, the confirmation of cancelation was accurate, then someone realised they'd made a mistake in allowing me to arrange to cancel so far ahead of time and stopped it. Then wiped the records of the calls, to cover their a**.
Whatever happened, I'd quite like to get back all the line rental money they've taken from me since march.
I asked them about my prospects of getting that money back, they told me 'none', because they didn't have records of my request to cancel.
Given that they did agree to cancel my contract (legally, even if their telephone chimp screwed up, they're still bound by his agreement, I'm pretty sure of that).
But without proof of asking them to cancel, I'm not sure how I can actually practically get my money back from them.
Any ideas?
Where do I stand and what can I do?
Oh well. I guess I'll write them a letter anyway, just on the offchance.
Now then, is there a legal way I can act out my vengence for being butt-raped by a bunch of incompetent co**faces making me pay for their f***-up?
Sadly, I tend to hold a grudge when I feel people have treated me particularly badly, and being told by their customer services that they're going to force me to pay for their incompetence qualifies for 'particularly badly'.
And sweet, sweet (legal) revenge is probably going to be the only way to get the monkey off my back.
Chain hoards of sheep, strapped to orange paint bombs, and lock them around the windows of all the T-Mobile headquarters. Say you want your contract ended or you'll force them to advertise for their competitors in a filthy woolly mess.
Pretty sure that they are not bound by a verbal request to cancel, nearly every similar thing I have seen - be it magazine subscriptions to Sky subscriptions, requires a written request to cancel even if you do phone up - that way there is proof. When sending such requests always send it recorded delivery so there is no doubt that you sent it and sent it when you said.
I don't think you have a chance to be honest, unless you get someone feeling sympathetic but T Mobile customer service is notoriously bad. Yesterday's Express, in the consumer section, had the case of a woman who had her mobile stolen, but because it was an old one it took her a week to notice. In which time the thief had run up over £1000 of calls on her account, when normally she would make around £10 of calls a month. T Mobile billed her because she only notified them after a week when she realised it was gone so they said she was liable. She pointed out to them the unusual call patterns - all but T Mobile contact contract users if their call pattern really changes significantly - but T Mobile insisted. It was only after these idiots at the Express stepped in that T Mobile agreed to reduce the bill but they still made her pay for a good size of it.
Moral of the story - T Mobile are crap.
Have you used the phone since?
If you have then you might be stuck, if not then you really should be able to get something back out of it.
I wouldn't be so "ok" with it, phone them up and tell them that you want the money back or you will be speaking to your lawyer as you definately cancelled it and someone at t-mobile has messed up and its not your problem.
