Sorry but how can you be bothered about things like that, if you look almost every film has something in it that breaks continuity or "just wouldn't happen".

I hate seeing a film in which an actor is appearing who has already been in another film. I'm like you know all "well one minute you were happy to take money to be Legolas and now you expect me to believe that you are a Pirate or a Milkman?"

I remember walking out of the cinema screaming my disgust when I realised that the kids who were in Helms Deep also appear in Minis Tirith, which is impossible. How can you take a film about Orcs and Goblins seriously if this sort of thing happens?
