They shouldn't have been blind.
They would also take into account where the accident took place and how it could have been avoided.
There is a difference between someone walking out in front of a car on the motorway and someone who trips in front of a speeding motorist outside a school.
My guess is that it's true in America but not here.

If the pedestrian ran across the road straght in front of the car he wouldn't get prosecuted.
There's nothing they can do. If the law states that it is entirely the drivers fault then you would be able to run in front of a car, get hit and get guarenteed compensation every time.
Only at designated crossing areas is the driver obliged to stop, anywhere else they have the right of the road.
Just think, you're basically saying that a pedestrian walking down the middle of a main road is doing it completely under the safety of the law...
