Here's an idea. Why not just try sort it out with the school first eh?
You may be able to sue, but it'll cost if you lose and you'd have to establish direct blame or incompetence on the part of the teacher, probably.

I remember my friend handed in an essay and the teacher lost it. So he said he'd bring in another copy the next day. He did and the teacher took marks off for it being late.
I laughed, then my friend went mental. Turned out he forgot he lost it, now there's a man you can trust.
No biggie really.
