They'd basically have to try and copyright radio, and I don't think they'd get away with it.

It's not exactly new technology, y'know - it's no different to a radio controlled car, is it? It just hadn't been used in game controllers before, and that was probably more down to the price than anything else.
The controller for my Tamiya r/c car cost £45, and that only has analogue left/right and forward/reverse! Nowhere near as complex!
