And the contracts of the employees could be quite important too, they may have clauses to prevent them working in the industry for an agreed period after they leave the company. Doubt the guys would want to sit on the sidelines for a couple of years just to spite gates.
That said, i think the free radical guys went straight there from rare, so it sounds like they don't have such clauses.
And i like the perfect dark label :^)

But after the timesplitters guys went to start free radical, rare went on to match their work on goldeneye with perfect dark, based on their work.
So it's not *just* the staff currently there, it's the intellectual property too.
