Vispa have just introduced an AUP restriction on my account - I'v ebeen booted off until the 1st. This wasn't in the T&C when I signed up, as I checked. Anyone know what my legal position on this is?

Well, Vispa have a reputation for being the best, and they quickly backed down when newspapers were mentioned.

Basically on the legalities it depends on a few issues. The main one being are you paying for the service directly. By which i mean are you paying the ISP for the service or just paying your phone bills. If you are paying then you can try to have a go at them for this change. Also did they have the magic "We reserve the right to change the T & C at any time for any reason" clause. If so there's not a lot you can do. Freeola has this clause, but it has only been used to change out T & C to make things clearer or to stop issues we didn't realise were issues when we wrote the first draft (ie. spaming). I can remember both NTL and BT changing there T & C's so that they could kick people who were over using there 0800 access. These people couldn't actually stop BT from doing this but they did manage to get noticed by a lot of the computer and even regular press who reported it and probably did quite a bit of damage to the reputations (although those companies didn't exactly have good reps to start with).

The legalitites are that when you signed up, you agreed that they could change their AUP, so they are free to change it whenever they like.

Yes, but I seriously doubt the legalities of that, seeing as that's basically "Sign up to these rules, but we haven't decided what the rules are yet, so you mat have to end up performing sexual acts with a goat" etc...
