It plays fine but do you think that it will get worse?
I bought it from Toys 'r' us, should I get them to change it or contact Nintendo?

Also, how long you had the controller for? Hopefully the 90 day warranty will still be valid. If not just march in there and say you want a replacement. If they say the warrantys out or something, just say that the control has to be of merchantable quality under the consumer goods act. We learnt that in business studies. Apparently, say that to them and they'll just replace it or you could sue them... :D
