If they don't it will be a disaster for the team. The investors expected to start racing immediately with the AP05. They also had drivers lined up, Tomas Enge and Gaston Mazzacane, I believe. It would be a huge disappointment for them if they are not allowed to race.They must have had sponsers ready and if they are not allowed to join soon they could go the way of Prost. The team would also add to the F1 grid which can only make the sport more competitive.
On the other people like Paul Stoddart feel the team should not be able to race in Prost's place as they have not payed off Prost's debts like he had to do at Minardi. The price payed by Phoenix for Prost's was far less than he payed for Minardi.
In my opinion the FIA should allow Phoenix into Brazil at the earliest. There is no point stopping a team from entering as it will only improve Formula 1 and it's competitiveness. More drivers means more young drivers and future world champions.

We discovered yesterday that the new Phoenix team had arrived in Kuala Lumpur in an attempt to run the two Prost AP04 chassis in this weekend's Malaysian Grand Prix. There had been strong speculation that the outfit, purchased by British businessman Charles Nickerson for a little over 2 million Euros, were under the impression that they could join in the 2002 championship season despite Formula One supremo Bernie Ecclestone laughing off their attempts.
With their arrival at Sepang yesterday, further questions were raised as it became clear that they would run TWR engines with Gaston Mazzacane and Tarso Marques at the wheel. It was earlier speculated that Tomas Enge would pilot the second car, however the young Czech driver is otherwise occupied this weekend.
However, as expected by many, their audacious bid was dashed by the world motorsport's governing body within hours of their arrival. The FIA explained that because the court overseeing the winding up of Prost Grand Prix had not transferred the team's entry into this season's championship, Phoenix simply could not take part in the Malaysian Grand Prix, not even on a provisional basis.
"Phoenix Finance Limited and Mr. Charles Nickerson have informed the FIA that they have purchased certain assets from the judicial liquidator of Prost Grand Prix and have indicated that they intend to present two cars for scrutineering at the Malaysian Grand Prix," the statement said. "Having examined the judgment of the Tribunal de Commerce de Versailles (the court overseeing the liquidation of Prost Grand Prix), the FIA's advisers have noted that the court has not transferred Prost Grand Prix itself nor made any attempt to transfer the Prost Grand Prix entry in the 2002 Formula One World Championship, either to Phoenix Finance Limited or to Mr. Nickerson. The FIA has therefore informed Phoenix and Mr. Nickerson that they are not entered in the 2002 FIA Formula One World Championship and that it cannot allow them to participate in Malaysia even on a provisional basis."

So it looks like they didn't buy the entry to this years Championship.
Also the Phoenix consortium bought all Prosts assets to pay off the liquidators. Therefore they are a different team. Max Moseley has said before the season a team could buy Prosts assets and compete before Austalia or anyone could take Prost's place during the season. As they didn't start in Australia they are not eligible for the 9th place TV money and presumably car numbers 18 and 19. This may mean the right to compete Phoenix claim to have bought may now be void.
Whatever happens I'm sure Phoenix will get the cars crash tested by Brazil and aim to compete. If this happens they may start to test and develop the AP05.
A lot has obviously gone on away from the media so no one really knows what is going to happen. I hope they are succesful in joining the grid.
In my opinion, the more cars the better.
For a start it's not Prost, it's some British bloke (Charles Nickerson - off the top of my head) and he has the support of Tom Walkinshaws TWR Engineering team.
However, as I understand it, Phoenix has ONLY bought a couple of AP05 Chassis, and NOT the teams entry into the Championship.
They should not be allowed to enter, as they have not lodged the $48million with the FIA (that all new teams are required to do - they get it back over their second and third seasons in the sport).
Not only that, but they haven't paid off Prosts debts. So they are effeftively getting free entry into the sport.
They should either enter as a new team, and give the FIA the $48million (as Toyota did), or they should buy Prost completely, in which case they would gets Prosts debts, but they would also get the TV money that Prost earnt from finishing 9th in the championship last year (like Paul Stoddard had to when he took over Mindardi).
Also, they woukdn't really add to F1, in my view. Not being to rude, but neither drivers are much cop, and the chassis have only been half developed. Chances are they would have been on the back row of the grid anyway.
