Miss Jackson (28), of, Grimsby, claimed she was smoking a cigarette with her partner Mr Hewitt (28) in Top Town when a community warden fined them - because it was expected they would drop their cigarette ends when they had finished.
The couple say they were so frustrated that they were being fined when they had not dropped any litter, they threw the butts on the ground in defiance.
The incident happened on the same day Michael Cohu was fined for feeding pigeons.
Miss Jackson said: "Me and my partner were standing outside Wilkinson's.
"We were smoking a cigarette when a warden came over and started reading me my rights.
"My partner and I looked at each other in bewilderment and then looked at the warden.
"He asked us for our details and when we asked why he told us we were being given a £50 fixed penalty notice each.
"My partner said 'Why? What have we done?' He then said it had looked like we were going to drop our cigarettes on the floor.
"We were gobsmacked because it was so ridiculous.
"Out of frustration and in protest we both then threw our cigarette ends on the floor. We thought if we are going to be fined, we might as well get our money's worth."
A spokeswoman for North East Lincolnshire Council said the fine had been issued because the couple had been "observed dropping litter".
She added: "North East Lincolnshire Council operates a zero tolerance policy towards littering and dog fouling.
"Individuals failing to dispose of the waste in an appropriate manner will be issued with a fixed penalty notice under the Environmental protection Act 1990 and the Dogs (Fouling of Land) Act 1996."
A community warden has also confirmed that in theory smokers could be fined for flicking their ash - though he had never heard of this happening.
He told the Telegraph: "Theoretically it is up to the discretion of the warden, bearing in mind it is in theory waste from the cigarette."

I think it is really going to get out of hand. They looked like they were going to drop it :s Also said they were seen littering before, if that was the case why didnt they get picked up on something they did do. Rather then something they didnt do.
My god, what will it be next, police walking round arresting people, 'oh, you looked like you were going to rob that bank'
Just how far are the laws going to get, to think that some wardens think that its possible to get done for flicking ash.
Ok so they put this ban in place, dont you think it would be good to have the appropriate things in place, fot things like fag butts.
People have to go outside and smoke, your lucky if there is a bin outside most places.
