Short version:
Recieved 3 tickets for parking outside girlfriend's place. Road is not Ealing Council area but Hammersmith.
Ealing keep giving me tickets and I keep refusing to pay them.
They send a letter giving intention of bailiff action on Saturday, I go ballistic and try to reach them.
Solicitors get involved this morning, and this afternoon I recieve this response from David Rumney, Head of Ealing Council Parking Services:
Mr Mason,
The Penalty Charge Notice is being cancelled. I can confirm that the location isn't in Ealing. I apologise in advance for the brief email response to your query, however I am looking into the matter and will get back to you shortly.

Except, after seeking legal advice, Ealing Council have ballsed up royally.
They have made so many mistakes on this that they are getting notification of intent to sue by myself on behalf of my QC.
Ealing Council, if anyone works for them and is reading this?
See you in court people, you screwed with a very hostile, very legally aware person that has made it his mission since studying law at college to be aware of every legal right and by-law that I can.

And Goatboy would like to point out that this thread is neither slander nor libel, as there is no intention of defamation, only a reporting of conversations by all parties involved, not has any one person been named as the sole party responsible for causing distress.
A name has been mentioned, but only in regards to an email recieved in response to a complaint.
Said person's comments have been noted in their entirety, and therefore no malicious actions described in either past duty or intent.

And it's most interesting, should someone phone their solicitor to discuss this, I would imagine the conversation might go something like this:
Goatboy (made up person of course)"What if Ealing has not had any control over this road since 1994 and continued to fine people for parking in a district that belongs to Hammersmith and Fulham for a period of 6 years?"
Lawyer "Well, if that is the case, then any fines issued would be illegal and non-valid."
Goatboy "Yeah...and?"
Lawyer "Well, that would mean that Ealing District Council would be liable to refund all the monies gained through these fines"
Goatboy "So, let me get this straight. Ealing would have to repay every single fine, over a period of 6 years?"
Lawyer "Indeed."
Wow, so that would mean that Ealing District Council would be liable for every single fine they imposed for the past 6 years? And they keep records for 14 years of all fines recieved. They would have to write to, and refund each and every person?
My, that could be an amount totalling £746,000 if someone investigated the amount by asking for the records utilising the Freedom of Information Act 1983.
Boy, I hope that someone wouldn't be so legally aware as to do anything like that, because that would mean a hell of a payout for Ealing Council.
And that would be terrible now.
