It can easily be monitored. Its Peer to Peer, so the Bittorrent software shows you all the IPs connected to you. So if a film/music/game company wants to they can connect to a torrent of a particular file and record all the people downloading on that torrent by IP address. As the IP address is basically the same as giving them your home address the company can then contact the ISP. It has happened to people in the UK and ISPs have given warnings to people and have given them all the details of the file, time, date etc when the offence was committed.
