The only way the second one works is if you emphasise the words 'that', 'us' and 'we'.

But I think the first one is correct.

Grammatically they are both correct.

For a proper judgement to be made we would need to know the rest of the paragraph that the line was included in.

I agree with Dr Gonzo. If you cut out the section in the commas, the sentence should still flow. However, you get "Instead of that weirdo, I say we kill him." which certainly doesn't feel quite righ on it's own. As I mentioned earlier, it's unclear what "Instead of" refers to.
