Apparently the controller isn't finalised yet either which makes it harder for developers to make games for it.

How much damage and injury did THAT cause? and yet he got a small sentence if I recall.

I didn't mean it, I hope the judge see's that, and realises this was just one big accident. Maybe I should be punished for being careless (although I was not as careless as my "partner in crime") but a Prison Sentence seems awfully harsh for someone who didn't mean to cause any damage and has never been in any kinda trouble before.
It's justthe £100,000 worth of damage. A nasty sticking point.
Perhaps you can swing an ASBO? They could ban you from handling flammable liquids for 6-12 months for instance and if cuaght THEN you would go to jail.
Or they could ban you from going out after 5pm for 6 months, beats jail anyway.

Just because the controller isn't finalised doesn't mean they don't know what it does.
The Gamecube's controller was changed slightly 2 months before launch and Miyamoto always said "It isn't quite finalised yet".
